May 16 | ACA Member Webinar: Overview of EPA’s Final RMP Amendments

This free webinar will provide an overview of the U.S. Environmental Protection Agency’s (EPA) recently finalized amendments to the Accidental Release Prevention Requirements for Risk Management Programs (RMP) under the Clean Air Act, Section 112(r)(7). EPA maintains that these modifications will improve process safety, aid in planning, preparing, and responding to RMP-reportable accidents, and improve public awareness to the surrounding communities.

With the U.S. Environmental Protection Agency (EPA) expected to publish several final risk management rules based on risk evaluations implementing revised policies, industry faces the prospect of seeing many established uses phased out as well as stringent existing chemical exposure limits (ECELs) that challenge the limits of current occupational exposure monitoring methods. May 30 | UV-Cure, “Shark Skin Bio-mimicking” Antimicrobial Surfaces for Autonomous Vehicles

This free webinar will help coatings formulators and suppliers understand technical development considerations to meet performance criteria for antimicrobial surfaces. Over the past several years, transmission of organisms on surfaces has become a point of focus. This webinar will review the use of UV-cure, “shark skin bio-mimicking” antimicrobial surfaces for autonomous vehicles (AV). These surfaces are naturally antimicrobial and a preferable alternative for their minimized environmental impact.

The number of AVs is expected to grow dramatically in the next five years, as ride-hailing options replace traditional taxi and Uber-style services. Future ride-hailing AVs are expected to have rapid “turn around” after individual use that should result in a microbial-free “touch surfaces.” The webinar will also address how coatings with anti-biofouling properties may be used for medical implants and in hospitals.

June 6 | Update on EPR Packaging and HHW Laws

This free webinar will provide an update on state-level Extended Producer Responsibility (EPR) laws to manage the end-of-life of packaging, as well as address recent EPR measures for household hazardous wastes (HHW) associated with the use of consumer products. This webinar will provide updates on the implementation and timetables for these laws across the country and overview ACA’s industry-wide approach to EPR.

July 11 | ACA Member Webinar: Impact of Loper Bright and Relentless Cases on Chevron Deference and the Power of Administrative Agencies

This free webinar with expert appellate litigators and Mayer Brown partners Timothy S. Bishop and Avi Kupfer will address the Loper Bright and Relentless rulings expected at the end of June. During this webinar, the presenters will address key takeaways and potential future impacts on the power of administrative agencies relative to the courts.

In January the U.S. Supreme Court heard tandem arguments with the potential to upend 40 years of administrative law precedent. Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Dept. of Commerce challenge the deference doctrine established by the landmark case Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. Under the Chevron deference doctrine, courts defer to an agency’s interpretation of gaps and ambiguities in statutes it implements, so long as that interpretation is reasonable. ACA was part of a coalition that filed an amicus brief in Loper Bright urging the U.S. Supreme Court to narrow or overturn Chevron deference to administrative agencies’ legal interpretation of statutes.
