OSHA Extends Comment Period for COVID-19 Vaccination Policy ETS

The Occupational Safety and Health Administration’s ETS intended to take effect on Dec. 6 mandates covered employers develop, implement and enforce a mandatory COVID-19 vaccination policy, unless they adopt a policy requiring employees to choose to either be vaccinated or undergo regular COVID-19 testing and wear a face covering at work. The ETS covers employers with 100 or more employees – firm or company-wide – and would preempt conflicting state laws. The ETS is currently being litigated, and the Fifth Circuit Federal Court of Appeals has issued a stay of enforcement. Read More…
