ACA Member Webinar: Legal Risk and Compliance for ‘Made in the USA’ Marketing Claims under Trump Administration

This free webinar will provide timely guidance on navigating heightened Federal Trade Commission (FTC) scrutiny of “Made in the USA” marketing claims under the Trump administration.

Under the second Trump administration, there is a clear tension between deregulatory rhetoric and targeted enforcement of origin-based marketing laws. In July 2025, FTC Chairman Andrew Ferguson declared it “Made in the USA Month,” stating: “‘Made in the USA’ is not just a slogan.”

Notably, On July 8, the FTC issued a press release about warning letters that were sent to four small companies that make “Made in the USA claims.” In the warning letters, FTC demands that the companies cease “Made in USA” claims unless they prove “all or virtually all” of the products in question are made domestically. Notably, on the same day, the FTC issued warning letters to Amazon and Walmart, urging them to monitor deceptive “Made in USA” claims from third-party sellers. This renewed enforcement signals that, despite broader deregulation, the FTC is closely aligning consumer protection with the administration’s emphasis on domestic production.
