Compliance Date for Amended Prop 65 “Clear and Reasonable Warnings” is August 29

Under Prop. 65, individuals must provide warnings prior to exposure to a chemical identified by the State of California to cause cancer or reproductive harm. A Prop 65 warning must be “clear and reasonable” under the law, and Article 6 provides safe harbor language that businesses can adopt to ensure compliance and protect them from enforcement.

U.S. EPA’s Nanoreporting Rule Compliance Date Nearing

The final nano-reporting rule requires a one-time reporting and recordkeeping of existing exposure and health and safety information on nanoscale chemical substances in commerce, and that companies that manufacture (including importing) or process certain chemical substances already in commerce as nanoscale materials notify EPA of certain information. The compliance date is Aug. 14, 2018.

EPA Releases List of 51 Parts of Country that Fall Short of Ozone Standards

In October 2015, EPA lowered both the primary (health-based) and secondary (welfare-based) NAAQS for ozone from the 2008-set 75 parts per billion (ppb) to 70 ppb, even though the higher 75 ppb standard was never fully implemented across the country. The 2015-set ozone standard is forcing a significant number of states that are currently “in attainment” to “non-attainment” status.
