Titanium Dioxide Classification Efforts in Europe

This webinar will provide an update on the status of the EU’s effort to establish a harmonized hazard classification for titanium dioxide under its Classification, Labeling and Packaging (CLP) regulation. Ongoing efforts by ACA and the U.S. government in conveying industry concerns and seeking to manage impacts, as well as efforts by EU-based associations for both the supplier and paint interests will be profiled. Additional supportive efforts that may be undertaken by companies and product stewardship professionals will also be addressed.

Green Building Standards Update

New Chemicals under TSCA

This webinar will address EPA’s proposed changes to the new chemicals review process under TSCA Section 5, whereby companies are required to submit a pre-manufacture notice (PMN) to EPA at least 90 days before they manufacture or import a new chemical substance in U.S. commerce, or manufacture or process a substance or mixture for a “significant new use.” The webinar will review EPA guidance and recommendations to aid companies as they go through the PMN process.

An Update on Prop 65 Implementation

This webinar will provide an update on the implementation of the revised Office of Environmental Health Hazard Assessment’s (OEHHA) amendments to Article 6, Clear and Reasonable Warnings, of the California Code of Regulations under Proposition 65 (Prop 65), which are effective Aug.30, 2018. Prop 65 requires anyone doing business in the state of California to provide a warning prior to exposure to a listed chemical(s). A Prop 65 warning must be “clear and reasonable” under the law, and Article 6 provides safe harbor language that businesses can adopt to ensure compliance and protect them from enforcement. The webinar will address the recent changes as they relate to the coatings industry and key implementation, compliance, and enforcement considerations.

Multi-Criteria Decision Analysis Within Alternatives Assessment Frameworks

This webinar will provide an overview of the use and benefits of the use of a Multi-Criteria Decision Analysis to assist the completion of the Alternatives Assessment. Alternatives Assessment (AA) is becoming a more common process of identifying, comparing, and selecting safer alternatives to chemicals that might pose a risk to humans or the environment. U.S. EPA and other regulatory bodies use alternatives assessments to look for safer chemicals. Chemical choices made based on these assessments can minimize the potential for unintended consequences that might occur in moving from a potentially problematic chemical to a poorly understood alternative, which could be more hazardous. In addition to the overview of the Multi-Criteria Decision Analysis system, this webinar will examine results from a recent paint thinner assessment.

CARB’s Suggested Control Measure for AIM Coatings

This webinar will provide an overview of the California Air Resources Board’s (CARB) development of a new Suggested Control Measure (SCM) for Architectural and Industrial Maintenance (AIM) coatings. Once complete, the California Air Districts and the Ozone Transport Commission (OTC) states will utilize the SCM to implement lower volatile organic compound (VOC) regulations for AIM coatings in California and the Northeast. The webinar will review CARB’s anticipated schedule as well as particular limits for AIM VOC coatings that CARB is contemplating.

Implementation of TSCA Inventory Reset and Risk Evaluation Rules

This webinar will address compliance criteria, challenges, and ongoing litigation related to U.S. EPA’s Inventory Reset Rule and Risk Evaluation Rule under TSCA. With EPA’s deadline for voluntary notification by processors under the TSCA Inventory Reset Rule set for Oct. 5, 2018, paint and coatings companies are facing significant challenges in identifying chemicals and confirming that chemical inventories will be commercially available once EPA publishes its final list of active and inactive chemicals. In addition to addressing these challenges, this webinar will review pending litigation involving the Inventory Reset Rule and how it might affect requirements to claim and substantiate Confidential Business Information and EPA’s policy for disclosure of information. The webinar will also examine EPA’s Risk Evaluation Rule, and address EPA’s first 10 risk evaluations under amended TSCA.

Update on State Chemicals Management Regulations

This webinar will address new legislative and regulatory efforts at the state level that are seeking to amend longstanding policies for the management of new and existing chemicals regulations. Prior to the modernization of TSCA, several states were working to adopt “Green Chemistry” bills. However, with the passage of the amended TSCA in June 2016, state-level chemicals management efforts were expected to decrease. This has not been the case; in 2017 alone, nearly 50 pieces of state legislation were introduced focusing on chemicals, ranging from bisphenol A (BPA) to mercury, to flame retardants; as well as several that focus on product reporting and ingredient disclosure. This webinar will explore these state chemicals management regulatory efforts, as well as what the coatings industry can expect moving forward from these bills.

ACA Big Data Project for Materials of Concern

This webinar will provide an overview of the ACA “Big Data” Materials of Concern project, overseen by the association’s Science & Technology Committee. The project centers on a grant to the North Carolina State University and its Center for Innovation Management Studies to develop a web-based tool to provide an early indication of emerging information on “chemicals of concern” used by the paint and coatings industry. The webinar will chart the progress of the project and address the forthcoming beta-test version of interface software that will allow for searches — using structured text analytics — of a metadata file derived from diverse public data sources.

VOC Regulations for Auto Refinish Coatings

This webinar will address regulatory development of volatile organic compound (VOC) rules for automotive refinish coatings throughout the United States. Varied programs regulate VOC emissions from auto refinish coatings at the federal, state, and local air district levels. Notably, the national auto refinish VOC regulation has been eclipsed by more stringent VOC limits from air districts in California and the states that comprise the northeast Ozone Transport Commission region. The webinar will focus on the present regulatory challenges for auto refinish coatings, especially with the revised National Ambient Air Quality Standard for ozone coming into effect.

Green Marketing Claims

This webinar will address issues around “Green Marketing” claims germane to volatile organic compounds (VOC) in paints and coatings. The Federal Trade Commission (FTC) is the lead agency charged with preventing unfair or deceptive acts or practices in, or affecting, commerce. Using the authority granted to it under Section 5 of the Federal Trade Commission Act (“FTC Act”), the agency has asserted jurisdiction over coatings products making “VOC-free” claims. The webinar will provide an overview and history of the FTC’s guidance on green marketing claims (“Green Guides”), a review of recent enforcement actions concerning “VOC-free” claims for select coatings products, and a summary of the agency’s guidance concerning “VOC-free” claims for architectural coatings.

Exempt Compound Update

This webinar will address exempt volatile organic compounds (VOCs) that are used in coatings. U.S. EPA has exempted many VOCs it has determined have negligible photochemical reactivity and therefore do not contribute to the formation of ground-level ozone. The benefit of exempt compounds is that they do not have to be counted towards the VOC content of a coatings product. This webinar will provide a status update on exempt VOCs used in coatings, and address possible alternatives.
